TERMS OF SERVICE

1. Usage of Dost
i. The Dost Platform (including mobile based applications and website) is provided by Dost Solutions Pvt. Ltd (“Dost”) either. Dost Solutions Pvt. Ltd is referred to as "Dost". Through the Dost Platform any person with a account can view and apply for jobs (“User”) through the Dost Platform, access and participate in the services provided by Dost. Jobs are posted by independent third parties not related to or affiliated with Dost.

ii. A User accessing the Dost Platform shall be bound by these Terms of Service, and all other rules, regulations and terms of use referred to herein or provided by Dost in relation to any services provided via the Dost Platform (“Dost Services”).

iii. Dost shall be entitled to modify these Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost in relation to any Dost Services, at any time, by posting the same on the Dost Platform. Use of the Dost Platform and Dost Services constitutes the User's acceptance of such modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost in relation to any Dost Services, as may be amended from time to time. Dost may, at its sole discretion, also notify the User of any change or modification in these Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost, by way of posting notifications in the User accounts or through any other mode of communication. The User may then exercise the options provided in such a notification to indicate non-acceptance of the modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost. If such options are not exercised by the User within the time frame prescribed in the notification, the User will be deemed to have accepted the modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost.

iv. Dost may, at its sole and absolute discretion:
Restrict, suspend, or terminate any User’s access to all or any part of the Dost Platform or Dost Services; Change, suspend, or discontinue all or any part of the Dost Platform or Dost Services; Reject, move, or remove any material that may be submitted by a User; Move or remove any content that is available on the Dost Platform; Deactivate or delete a User’s account and all related information and files on the account; Establish general practices and limits concerning use of Dost Platform; Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Users to their registered email IDs). v. In the event any User breaches, or Dost reasonably believes that such User has breached these Terms of Service, or has illegally or improperly used the Dost Platform or Dost Services, Dost may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User's access to all or any part of the Dost Platform, deactivate or delete the User's account and all related information on the account, delete any content posted by the User on Dost and further, take technical and legal steps as it deems necessary.

vi. If Dost charges its Users a platform fee in advance in respect of any Dost Services, Dost shall, without delay, repay such platform fee in the event of suspension or removal of the User's account or Dost Services on account of any negligence or deficiency on the part of Dost, but not if such suspension or removal is effected due to: any breach or inadequate performance by the User of any of these Terms of Service; or any circumstances beyond the reasonable control of Dost. vii . By accepting these Terms of Service Users are providing their consent to receiving communications such as announcements, administrative messages and advertisements from Dost or any of its partners, licensors or associates.

2. Participation
i. When accessing and interacting with the Dost Platform and Dost Services a User will be able to view and apply for jobs posted by potential employers for their respective organizations.
ii. To view and apply for a job a User shall be required to provide information about the User’s education, qualifications, past experience and skills. While Dost does not tolerate or allow for discrimination on the basis of gender, certain jobs might be gender specific and might be available only to persons of a certain gender. The User understands and acknowledges that such stipulations as to gender specifications for a certain job are not mandated by Dost and that such stipulation is made by the Employer.
iii. By agreeing to these Terms of Service and while applying for a job through the Dost Platform, Users undertake that all information shared will at all times be accurate and not be misleading. The User understands and acknowledges that any incorrect information or misrepresentations made by the User will affect the efficacy of the Dost Platform and Dost Services and that Dost shall have the right to suspend the User’s account if it is found that the information shared by the User is false or misleading.
iv. The job applications by the Users on the Dost Platform shall remain active only for a period of 30 (sixty) days from the date of application to the job posts and upon the expiry of the said period of 30 (sixty) days, such job applications shall be archived and it’s status will be changed from “Active” to “Inactive”. The potential employers shall not have access to the list of such Users or to the Inactive Job Applications upon the expiry of 30 (sixty) days. The Users, however, may re-apply to a job post (if still active) after the expiry of 30 (sixty) days from the date such User made their first application to the same job post.
v. Users agree that they shall at all times be bound by and adhere to the Code of Conduct while accessing the Dost Platform and while using the Dost Services.

3. Intellectual Property
i. The intellectual property rights ("Intellectual Property Rights") in all software underlying the Dost Platform and the Dost Services and material published on the Dost Platform, including (but not limited to) software, advertisements, content (whether written, audio and/or visual), photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clippings, animations etc. is owned by Dost, its affiliates, partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Dost either in whole or in part without express written license from Dost.
ii. Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available via the Dost Platform ("User’s Content"). Each User represents and warrants that they own all Intellectual Property Rights in the User’s Content and that no part of the User's Content infringes any third-party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on the Dost Platform, without written authorization from such third party. Users agree to indemnify and hold harmless Dost, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform, by such User or through the User's commissions or omissions
iii. Users hereby grant to Dost and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish User's Content for any of the following purposes:
displaying User’s Content on Dost distributing User’s Content, either electronically or via other media, to potential candidates, and/or storing User’s Content in a remote database accessible by end users, for a charge. This license shall apply to the distribution and the storage of User’s Content in any form, medium, or technology.
iv. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform belonging to any person (including a User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Dost.

4. Third Party Sites, Services and Products
i. Links to other Internet sites or mobile applications owned and operated by third parties may be provided via the Dost Platform. The User’s use of each of those sites is subject to the conditions, if any, posted by those sites. Dost does not exercise control over any Internet sites or mobile applications apart from the Dost Platform and cannot be held responsible for any content residing in any third-party Internet site or mobile application. Dost's inclusion of third-party content or links to third-party Internet sites or mobile applications is not an endorsement by Dost of such third-party Internet site or mobile application.
ii. A User’s correspondence, transactions/offers or related activities with third parties including but not limited to potential employers, payment providers and verification service providers, are solely between the User and that third party. A User’s correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. The User agrees that Dost will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor.
iii. The Dost Platform contains content that is created by Dost as well as content provided by third parties (including potential candidates). Dost does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the Dost Services provided on the Dost Platform.

5. Privacy Policy
i. All information collected from Users, such as registration (including but not limited to email addresses, mobile phone numbers, government identity documentation) and payment information, is subject to Dost's Privacy Policy which is available at Privacy Policy.
ii. We do not share personal information of any individual with other companies/entities without obtaining permission. We may share all such information that we have in our possession in accordance with our Privacy Policy
iii. Once the personal information has been shared with you, you shall, at all times, be responsible to secure such information.
iv. You warrant and represent that you shall not disclose or transfer personal information shared by us to any sub-processors without ensuring that adequate and equivalent safeguards to the personal information.
v. You, hereby agree and acknowledge that you will use the information shared with you only for the purpose of availing the Services. You shall not use such information for any personal or other business purposes. In the event you are found to be misusing the information shared with you, we shall, at our sole discretion, delete your account with immediate effect and you will be blocked from using/ accessing Dost Platform in future.

6 .User Conduct
i. Users agree to abide by these Terms of Service and all other rules, regulations and terms of use of the Dost Platform and Dost Services. In the event User does not abide by these Terms of Service and all other rules, regulations and terms of use, Dost may, at its sole and absolute discretion, take necessary remedial action, including but not limited to: restricting, suspending, or terminating any User's access to all or any part of the Dost Platform and Dost Services; deactivating or deleting a User's account and all related information and files on the account.
ii. Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Dost). Users further agree to update and keep updated their registration information and other information as may be required by Dost.
iii. A User shall not register or operate more than one User account with Dost.
iv. Users agree to ensure that they can receive all communication from Dost either by SMS, Whatsapp or any other mode of communication from Dost. Dost shall not be held liable if any any communication sent to the User by Dost remains unread by the User.
v. Any password issued by Dost to a User may not be revealed to anyone else. Users may not use anyone else's password. Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify Dost of any unauthorized use of their passwords or accounts or any other breach of security.
vi. Users agree to exit/log-out of their accounts at the end of each session. Dost shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.
vii. Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software designed to modify or interfere with the Dost Services and/or Dost experience or assist in such activity.
viii. Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying the Dost Platform or Dost’s Services.
ix. Users agree that without Dost's express written consent, they shall not modify or cause to be modified any files or software that are part of Dost's Services or the Dost Platform.
x. Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support the Dost Platform or Dost’s Services (each a "Server"); or (2) the enjoyment of Dost Services by any other User or person.
xi. Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt Dost Services or any other person's use or enjoyment of Dost Services.
xii. Users shall not attempt to gain unauthorised access to User accounts, Servers or networks connected to the Dost Platform or Dost Services by any means other than the User interface provided by Dost, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of the Dost Platform or Dost Services.
xiii. A User shall not publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
xiv. Without limiting the foregoing, Users agree not to use Dost for any of the following: To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication; To harass, stalk, threaten, or otherwise violate any legal rights of other individuals; To publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content; To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, Dost, any software, hardware, or telecommunications equipment; To advertise, offer or sell any goods or services for any commercial purpose on Dost including but not limited to multi-level marketing for a third party, promoting business of a third party, selling financial products such as loans, insurance, promoting demat account openings, without the express written consent of Dost; To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner; To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material; To restrict or inhibit any other User from using and enjoying any public area within our sites; To collect or store personal information about other Users; To collect or store information about potential candidates; To mine information relating to potential candidates with the aim of creating a database of potential candidates whether or not such database is used or meant to be used by the User or any third party associated with the User or to whom such User makes such mined information available, for either a commercial purpose of for the User’s own use at a future date; To interfere with or disrupt the Dost and/or the Dost Platform, Dost servers, or Dost networks; To impersonate any person or entity, including, but not limited to, a representative of Dost, or falsely state or otherwise misrepresent User's affiliation with a person or entity; To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Dost or to manipulate User's presence on the Dost Platform; To take any action that imposes an unreasonably or disproportionately large load on Dost’s infrastructure; To engage in any illegal activities. To engage in any action that threatens the unity, integrity, defence, security or sovereignty of Pakistan, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation.
xv. If a User chooses a username that, in Dost's considered opinion is obscene, indecent, abusive or that might subject Dost to public disparagement or scorn, or a name which is an official team/league/franchise names and/or name of any sporting personality, as the case may be, Dost reserves the right, without prior notice to the User, to restrict usage of such names, which in Dost’s opinion fall within any of the said categories and/or change such username and intimate the User or delete such username and posts from Dost, deny such User access to Dost, or any combination of these options.
xvi. Unauthorized access to the Dost Platform is a breach of these Terms of Service, and a violation of the law. Users agree not to access the Dost Platform by any means other than through the interface that is provided by Dost via the Dost Platform for use in accessing the Dost Platform. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of the Dost Platform, Dost Services or any information available for access through the Dost Platform or Dost Services, except those automated means that Dost has approved in advance and in writing.
xvii. Use of the Dost Platform is subject to existing laws and legal processes. Nothing contained in these Terms of Service shall limit Dost's right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of Dost.
xviii. Persons below the age of eighteen (18) years are not allowed to register with the Dost Platform. All persons interested in becoming Dost Users might be required by Dost to disclose their age at the time of getting access to the Dost Platform. If a person declares a false age, Dost shall not be held responsible and such person shall, in addition to forfeiting any and all rights over their Dost account, shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration being made. In case the person making the false declaration is below the age of 18 such person’s legal guardians shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration having been made by said person.
xix. Dost may not be held responsible for any content contributed by Users on the Dost Platform.

Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available via the Dost Platform ("User’s Content"). Each User represents and warrants that they own all Intellectual Property Rights in the User’s Content and that no part of the User's Content infringes any third-party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on the Dost Platform, without written authorization from such third party. Users agree to indemnify and hold harmless Dost, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform, by such User or through the User's commissions or omissions iii. Users hereby grant to Dost and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish User's Content for any of the following purposes: displaying User’s Content on Dost distributing User’s Content, either electronically or via other media, to potential candidates, and/or storing User’s Content in a remote database accessible by end users, for a charge. This license shall apply to the distribution and the storage of User’s Content in any form, medium, or technology. iv. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform belonging to any person (including a User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Dost. 4. Third Party Sites, Services and Products i. Links to other Internet sites or mobile applications owned and operated by third parties may be provided via the Dost Platform. The User’s use of each of those sites is subject to the conditions, if any, posted by those sites. Dost does not exercise control over any Internet sites or mobile applications apart from the Dost Platform and cannot be held responsible for any content residing in any third-party Internet site or mobile application. Dost's inclusion of third-party content or links to third-party Internet sites or mobile applications is not an endorsement by Dost of such third-party Internet site or mobile application. ii. A User’s correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. The User agrees that Dost will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor. iii. The Dost Platform contains content that is created by Dost as well as content provided by third parties (including potential candidates). Dost does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the Dost Services provided on the Dost Platform. 5. Once the personal information has been shared with you, you shall, at all times, be responsible to secure such information. iv. You warrant and represent that you shall not disclose or transfer personal information shared by us to any sub-processors without ensuring that adequate and equivalent safeguards to the personal information. v. You, hereby agree and acknowledge that you will use the information shared with you only for the purpose of availing the Services. You shall not use such information for any personal or other business purposes. In the event you are found to be misusing the information shared with you, we shall, at our sole discretion, delete your account with immediate effect and you will be blocked from using/ accessing Dost Platform in future. 6 .User Conduct i. In the event User does not abide by these Terms of Service and all other rules, regulations and terms of use, Dost may, at its sole and absolute discretion, take necessary remedial action, including but not limited to: restricting, suspending, or terminating any User's access to all or any part of the Dost Platform and Dost Services; deactivating or deleting a User's account and all related information and files on the account. ii. Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Dost). Users further agree to update and keep updated their registration information and other information as may be required by Dost. iii. A User shall not register or operate more than one User account with Dost. iv. Users agree to ensure that they can receive all communication from Dost either by SMS, Whatsapp or any other mode of communication from Dost. Dost shall not be held liable if any any communication sent to the User by Dost remains unread by the User. v. Any password issued by Dost to a User may not be revealed to anyone else. Users may not use anyone else's password. Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify Dost of any unauthorized use of their passwords or accounts or any other breach of security. vi. Users agree to exit/log-out of their accounts at the end of each session. Dost shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements. vii. Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software designed to modify or interfere with the Dost Services and/or Dost experience or assist in such activity. viii. Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying the Dost Platform or Dost’s Services. ix. Users agree that without Dost's express written consent, they shall not modify or cause to be modified any files or software that are part of Dost's Services or the Dost Platform. x. Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support the Dost Platform or Dost’s Services (each a "Server"); or (2) the enjoyment of Dost Services by any other User or person. xi. Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt Dost Services or any other person's use or enjoyment of Dost Services. xii. Users shall not attempt to gain unauthorised access to User accounts, Servers or networks connected to the Dost Platform or Dost Services by any means other than the User interface provided by Dost, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of the Dost Platform or Dost Services. xiii. A User shall not publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person. xiv. Without limiting the foregoing, Users agree not to use Dost for any of the following: To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication; To harass, stalk, threaten, or otherwise violate any legal rights of other individuals; To publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content; To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, Dost, any software, hardware, or telecommunications equipment; To advertise, offer or sell any goods or services for any commercial purpose on Dost including but not limited to multi-level marketing for a third party, promoting business of a third party, selling financial products such as loans, insurance, promoting demat account openings, without the express written consent of Dost; To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner; To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material; To restrict or inhibit any other User from using and enjoying any public area within our sites; To collect or store personal information about other Users; To collect or store information about potential candidates; To mine information relating to potential candidates with the aim of creating a database of potential candidates whether or not such database is used or meant to be used by the User or any third party associated with the User or to whom such User makes such mined information available, for either a commercial purpose of for the User’s own use at a future date; To interfere with or disrupt the Dost and/or the Dost Platform, Dost servers, or Dost networks; To impersonate any person or entity, including, but not limited to, a representative of Dost, or falsely state or otherwise misrepresent User's affiliation with a person or entity; To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Dost or to manipulate User's presence on the Dost Platform; To take any action that imposes an unreasonably or disproportionately large load on Dost’s infrastructure; To engage in any illegal activities. To engage in any action that threatens the unity, integrity, defence, security or sovereignty of Pakistan, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation. xv. If a User chooses a username that, in Dost's considered opinion is obscene, indecent, abusive or that might subject Dost to public disparagement or scorn, or a name which is an official team/league/franchise names and/or name of any sporting personality, as the case may be, Dost reserves the right, without prior notice to the User, to restrict usage of such names, which in Dost’s opinion fall within any of the said categories and/or change such username and intimate the User or delete such username and posts from Dost, deny such User access to Dost, or any combination of these options. xvi. Unauthorized access to the Dost Platform is a breach of these Terms of Service, and a violation of the law. Users agree not to access the Dost Platform by any means other than through the interface that is provided by Dost via the Dost Platform for use in accessing the Dost Platform. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of the Dost Platform, Dost Services or any information available for access through the Dost Platform or Dost Services, except those automated means that Dost has approved in advance and in writing. xvii. Use of the Dost Platform is subject to existing laws and legal processes. Nothing contained in these Terms of Service shall limit Dost's right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of Dost. xviii. Persons below the age of eighteen (18) years are not allowed to register with the Dost Platform. All persons interested in becoming Dost Users might be required by Dost to disclose their age at the time of getting access to the Dost Platform. If a person declares a false age, Dost shall not be held responsible and such person shall, in addition to forfeiting any and all rights over their Dost account, shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration being made. In case the person making the false declaration is below the age of 18 such person’s legal guardians shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration having been made by said person. xix. Dost may not be held responsible for any content contributed by Users on the Dost Platform.

7. Eligibility
The Dost Platform is open only to persons above the age of 18 years. The Dost Platform is open only to persons, currently residing in Pakistan. Persons who wish to participate must have a valid mobile phone number. Dost may on receipt of information bar a person from accessing their Dost account if such person is found to be in violation of any part of these Terms of Service or the Code of Conduct. Only those Users who have successfully registered on the Dost Platform shall be eligible to Post view and/or apply for jobs via the Dost Platform.

8. Dispute and Dispute Resolution
i. If any dispute arising out of, or in connection with, the Dost Services provided by Dost via the Dost Platform, the construction, validity, interpretation and enforceability of these Terms of Service, or the rights and obligations of the User(s) or Dost, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below arises between the User(s) and Dost (“Dispute”), the disputing parties hereto shall endeavor to settle such Dispute amicably. The attempt to bring about an amicable settlement shall be considered to have failed if not resolved within 30 (thirty) days from the date of communicating the Dispute in writing.
ii. If the parties are unable to amicably settle the Dispute as mentioned above, any party to the Dispute shall be entitled to serve a notice invoking Arbitration. The Dispute shall be referred to and finally resolved by arbitration. The Arbitration shall be conducted by an Arbitral Tribunal consisting of a sole arbitrator in accordance with the Law of Islamic Republic of Pakistan. The language of the arbitration shall be English. The law governing the arbitration agreement shall be Pakistan’s Law.
iii. Nothing shall preclude any Party from seeking interim or permanent equitable or injunctive relief, or both, having jurisdiction to grant relief on any Disputes. The pursuit of equitable or injunctive relief shall not be a waiver of the duty of the Parties to pursue any remedy (including for monetary damages) through the arbitration described herein.
iv. The arbitration award will be final and binding on the Parties.

9. Release and Limitations of Liability
i. Users shall access the Dost Services provided via the Dost Platform voluntarily and at their own risk. Dost shall, under no circumstances be held responsible or liable on account of any loss or damage sustained by Users or any other person or entity during the course of access to the Dost Platform.
ii. By accessing the Dost Platform and Dost Services provided therein, Users hereby release from and agree to indemnify Dost, and/or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access of the Dost Platform and the Dost Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
iii. Dost accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the data/information collated and published on the Dost Platform.
iv. Users shall be solely responsible for any consequences which may arise due to their access of Dost Services by conducting an illegal act or due to non-conformity with these Terms of Service and other rules and regulations in relation to Dost Services, including provision of incorrect personal details. Users also undertake to indemnify Dost and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Dost on account of such act on the part of the Users.
v. Users shall indemnify, defend, and hold Dost harmless from any third party/entity/organization claims arising from or related to such User&apso;s engagement with the Dost Platform. In no event shall Dost be liable to any User for acts or omissions arising out of or related to User's engagement with the Dost Platform.
vi. In consideration of Dost allowing Users to access the Dost Platform, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Dost, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of Dost Services.

10. Disclaimers
i. To the extent permitted under law, neither Dost nor its subsidiary, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.
ii. To the extent permitted under law, Dost shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, products, Dost Services or sites.
iii. Any material accessed, downloaded or otherwise obtained through the Dost Platform is done at the User & aps’s discretion, competence, acceptance and risk, and the User will be solely responsible for any potential damage to User's computer system or loss of data that results from a User's download of any such material.
iv. Dost shall make best endeavours to ensure that the Dost(s) is error-free and secure, however, neither Dost nor any of its partners, licensors or associates makes any warranty that:
the Dost Platform will meet Users' requirements, Dost Platform will be uninterrupted, timely, secure, or error free the results that may be obtained from the use of Dost Platform will be accurate or reliable; and the quality of any products, Dost Services, information, or other material that Users purchase or obtain through the Dost Platform will meet Users' expectations.
v. In case Dost discovers any error, Dost reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit. In case of exercise of remedies in accordance with this clause, Dost agrees to notify the User of the error and of the exercise of the remedy(ies) to rectify the same.
vi. To the extent permitted under law, neither Dost nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if Dost has been advised of the possibility of such damages.
vii. Any Dost Services being hosted or provided, or intended to be hosted on the Dost Platform and requiring specific permission or authority from any statutory authority or any state or the federal government, or the board of directors shall be deemed cancelled or terminated, if such permission or authority is either not obtained or denied either before or after the availability of the relevant Dost Services are hosted or provided.
viii. To the extent permitted under law, in the event of suspension or closure of any Dost Services Users shall not be entitled to make any demands, claims, on any nature whatsoever.

Dost App is a commercial app by Dost Solutions Pvt. Ltd ("DOST"). This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information for anyone using the app and website of DOST ("Dost Platform"). By using Dost Platform, you consent to the terms of our privacy policy ("Privacy Policy") in addition to our Terms of Service. We encourage you to read this Privacy Policy regarding the collection, use, and disclosure of your information from time to time to keep yourself updated with the changes & updated that we make to this Privacy Policy.

1. Personal Identification Information
If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. ii. We use your Public Profile, to help connect you with friends and family which increases your and your friends' chances to find suitable job opportunities.

We may collect non-personal identification information about users whenever they interact with our site. Non-personal identification information may include the type of mobile phone and technical information about users, such as the operating system and the Internet service providers utilized including IP address and other similar information.

3. Usage and Technical Information
We collect the information about how you interact with our Service. This information may include your IP address, geographical location, browser type, referral source, length of visit, pages viewed and items clicked.

4. Information Collection
For a better experience, while using our Service, you are required to provide us with certain personally identifiable information for your Public Profile, including but not limited to:

We are committed to be transparent about the data we collect about you, how it is used and with whom it is shared. When you use the services of our customers and partners, such as employers or prospective employers and applicant tracking systems, we share your Public Profile (e.g., your job title and name of the company where you work) with prospective employers to enable you to get job interviews.

5. Data Collection Types
i. Contacts List.
When you sync your contacts with our Services, we import and store the contacts list to our servers. You have the option to deny us the access to your contacts list. We also receive personal data (including contact information) about you when others import or sync their contacts with our Services.
ii. Location Information. When you give location permission, we access information that is derived from your GPS. We may use third-party cookies and similar technologies to collect some of this information.
iii. Storage. When you opt-in for storage permission, we access your device storage like gallery photos.
iv. Camera. Granting camera permission allows us to access the photo that you click to be displayed on your resume.

To monitor usage or traffic patterns (including to track users' movements around the Services) and gather demographic information. To communicate directly with you, including by sending you information about new products and services. To deliver you a personalized experience. May come in the form of messages and/or WhatsApp delivering tailor-made ads based on your interest and browsing history. To the extent permitted by the applicable law, we may record and monitor your communications with us to ensure compliance with our legal and regulatory obligations and our internal policies. By registering on the Platform and consenting to the terms of this Privacy Policy, you agree that we may contact you or share your contact details with the candidates for the purpose of the Services; Potential recruiters/ employer if we determine that your profile matches a particular job description/ vacancy available with such recruiters. By registering on the Platform and consenting to the terms of this Privacy Policy, you agree that we may contact you or forward your resume to potential recruiters; Third parties including enforcement, regulatory and judicial authorities, if we determine that disclosure of your personal information is required to a) respond to court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims; or b) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or as otherwise required by law; In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets we may disclose personal information to those involved in the negotiation or transfer. Whenever you use our Service, including our sites, app and platform technology, such as when you view or click on content (e.g., learning video) or perform a search, install or update one of our mobile apps, post messages or apply for jobs and in a case of an error in the app we collect data and information (through third-party products) on your phone called Log Data. This Log Data may include information such as log-ins, cookies, your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics to identify you and log your use.

But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

You have to use your actual name on the Platform, you are required to input your correct phone number to use our Services. You will be getting a job based on your DOST account. You will not falsely represent yourself as another person or representative of another person to use our Services. You will not lie about your details, for any reason.

17. Trust and Safety
DOST takes the trust and safety all its users seriously. We do not allow content that promotes abuse, fraud, job openings that charge fees, suicide, self-harm, or is intended to shock or disgust users. Strict action is taken against such content and with people posting such messages/content in the group. To ensure the best possible experience for all the users of the app, we have established some basic guidelines called the Community Guidelines. The Community Guidelines gets updated periodically. You will be notified when this happens.

18. Disclaimer
Dost does not hold any responsibility for any incident, fraud, cheat or crime that may happen to any users. We advise you to check and verify information of other users before proceeding with any transactions or interaction among users. Also, do not share your private information on group, to prevent the use of such information for any un-safe purposes. When you see something inappropriate or come across an offending content, click on the 3 vertical dots on the top right corner of the post and choose to 'report' post. This alerts the admins about the post and allows for necessary action to be taken. What to do if you find suicide & self-injury related content If you come across content in which someone expresses suicidal thoughts or is engaging in self-harm, click on the 'report' post button. USER GENERATED CONTENT POLICY AND COMMUNITY GUIDELINES

These Community Guidelines (“Guidelines”) govern your use of Dost Platform (including any mobile based applications, website and web applications) as made available by Dost Solutions PVT Ltd (“Dost”, “Company”, “we”, “us” and “our”). These Guidelines are to be read with the Terms and Conditions and the Privacy Policy (collectively, “Terms of Use”). The capitalized words used in these guidelines shall have the meaning given to such words in the Terms. The Dost Platform provides with a marketplace for recruiters and potential employees to connect with each other, a social community for Users to interact with each other in relation to their chosen industries, groups for its Users to post and share content and other services related to enhancing access to employment in Pakistan. When you register and join the Dost Platform, you become a member and a mandatory part of the groups on the Dost Platform and additionally you may choose to become part of other communities based on your interest. The Dost Platform is accessed by a diverse audience and in order to ensure that all our Users follow a standard practice and to foster a safe environment for you to express yourself, we have put in place strict guidelines and restrictions which govern the usage of the Dost Platform. These guidelines and restrictions may not be exhaustive and we reserve the right to decide, in our sole discretion, what content violates the Terms of Use and how we want to deal with such violations. We reserve the right to change these Guidelines at any time.

1. APPLICABLE LAW
i. All content must adhere to applicable law. All Registered Users must ensure that the content they upload adheres to and conforms with applicable law.
ii. Content may not be uploaded, posted, commented on, or shared by you if it threatens the unity, integrity, defence, security or sovereignty of Pakistan, friendly relations with foreign States, or public order. 2. ZERO TOLERANCE POLICY
The Dost Platform has a Zero Tolerance Policy for –
i. any content or behavior that discriminates on the basis of age, sex, gender identity and expression, religion, caste, ethnicity, community, disability, nationality, race, immigration status, sexual orientation, victims of a major violent event and their kin; and
ii. content that propagates hate or violence towards an individual or a group whether or not based on age, sex, gender identity and expression, religion, caste, ethnicity, community, disability, nationality, race, immigration status, sexual orientation, victims of a major violent event and their kin; and
iii. content related to organized crime, criminal activities, promotion/sale/use of weapons, firearms and explosives, violence or terrorist activities; and
iv. sale of illegal goods or services, regulated goods, drugs and controlled substances, and soliciting or selling of sexual services; and
v. content that propagates or showcases dangerous challenges or pranks; and
vi. content that is harassing, harmful, or abusive to children; and
vii. content that is related to or encourages money laundering or gambling; and
viii. content that is misleading, false or is designed specifically to spread misinformation; and
ix. content that displays tutorials, instructions etc. relating to the commission of illegal activities, or activities that can harm or endanger an individual or group of persons; and
x. harassment or bullying through the use of abusive language or curse words; and
xi. false information posted to harass someone for financial gain, or cause any injury to them; and
xii. harassment or cyberbullying which includes name calling or malicious insults (such as racial slurs) based on someone's attributes (including physical attributes); and
xiii. content that encourages, glorifies or induces people to indulge in self harm, abuse or suicide; and
xiv. animal abuse; and
xv. any content related to Multi-Level Marketing/ direct marketing/ network marketing/ digital marketing; and
xvi. links for earning money by referral/ online games; and
xvii. fake or fraudulent job openings and engagement; and
xviii. spamming

3. NUDITY, PORNOGRAPHY AND SEXUALLY EXPLICIT CONTENT
The Dost Platform does not allow nudity, pornography or any form of sexually explicit content. Specifically, content which contains the following will be considered violation of these Guidelines and shall result in the suspension or absolute ban on your access to the Dost Platform:
i. Obscene, sexually explicit, pornographic (including without limitation, creation, promotion, glorification, transmission or browsing of pornography) or nude material or images/videos that expose private parts and/or portray sexual activities;
ii. videos or images of people in compromising positions or content which portrays sexual actions or fetish or erotic intent or sexual arousal;
iii. sextortion or revenge pornography;
iv. bestiality or zoophilia whether explicit or implied;
v. necrophilia whether explicit or implied;
vi. content that exploits or endangers any person (for example, listing of phone numbers, or other personal information aimed at any exploitation or endangerment of a person including for the purposes of encouraging or soliciting prostitution or escort services);
vii. content that is paedophilic or related to child pornography (including without limitation, creation, promotion, glorification, transmission or browsing of child pornography); or
viii. content that is indecent, immoral or related to rape, sexual assault, sexual objectification, non-consensual activities and molestation.

4. INTELLECTUAL PROPERTY
Content should not violate the intellectual property rights of a third party. Content that is a third party’s intellectual property includes –
i. literary, musical, dramatic, artistic, sound recordings, cinematographic works;
ii. content that is not original and is copied from an individual/organization who owns the intellectual property rights in such content/works ;
iii. content that displays a logo, trademark, trade name or any other identifiers relating to a third party without the consent of such third party. Any content that is found to be in violation of a third party’s intellectual property rights will be taken down. Any Users found to be repeatedly posting content that infringes a third party’s intellectual property shall have their access to the Dost Platform suspended or blocked.

5. NON-CONSENSUAL CONTENT
Content, data, or information of another person, including their pictures or videos without obtaining their prior consent to use such content, data or information on the Dost Platform is strictly prohibited. You shall not post anyone’s personally identifiable information (including but not limited to their name, phone number(s), address, email id, bank account or other financial information) or their photographs or videos without their permission or consent. You shall not post content that is invasive of anyone’s privacy. We will remove such content. Any content that violates the above shall be immediately removed and Users who repeatedly post such content shall lose access to the Dost Platform.

6. REPORTING
While Dost makes every possible effort to ensure that all content is moderated to ensure adherence to and compliance with the Terms of Use and specifically these Guidelines we may not always be able to identify content that is violative. We, therefore, rely on our Users to report content that they feel might be in violation of the Terms of Use and specifically these Guidelines. We encourage you to report the post which might be in violation of the Terms of Use/these Guidelines.

TERMS OF SERVICE

1. Usage of Dost
i. The Dost Platform (including any mobile based applications, website and web applications) is provided by Dost Solutions PVT Ltd ("Dost"). Through the Dost Platform any person with an account can post jobs ("Employer") to the Dost Platform, access and participate in the services provided by Dost. By using Dost Platform, you consent to the terms of the Terms of Service in addition to our Privacy Policy.
ii. An Employer accessing the Dost Platform shall be bound by these Terms of Service, and all other rules, regulations and terms of use referred to herein or provided by Dost in relation to any services provided via the Dost Platform ("Dost Services").
iii. Dost shall be entitled to modify these Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost in relation to any Dost Services, at any time, by posting the same on the Dost Platform. Use of Dost constitutes the Employer's acceptance of such modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost in relation to any Dost Services, as may be amended from time to time. Dost may, at its sole discretion, also notify the Employer of any change or modification in these Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost, by way of sending an email to the Employer's registered email address or posting notifications in the Employer accounts. The Employer may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost. If such options are not exercised by the Employer within the time frame prescribed in the email or notification, the Employer will be deemed to have accepted the modified Terms of Service, rules, regulations and terms of use referred to herein or provided by Dost.
iv. Certain Dost Services being provided on Dost may be subject to additional rules and regulations set down in that respect. To the extent that these Terms of Service are inconsistent with the additional conditions set down, the additional conditions shall prevail. Dost may, at its sole and absolute discretion: Restrict, suspend, or terminate any Employer's access to all or any part of the Dost Platform or Dost Services; Change, suspend, or discontinue all or any part of the Dost Platform or Dost Services; Reject, move, or remove any material that may be submitted by a Employer; Move or remove any content that is available on the Dost Platform; Deactivate or delete a Employer's account and all related information and files on the account; Establish general practices and limits concerning use of Dost Platform; Assign its rights and liabilities to all Employer accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Employers to their registered email ids).
v. In the event any Employer breaches, or Dost reasonably believes that such Employer has breached these Terms of Service, or has illegally or improperly used the Dost Platform or Dost Services, Dost may, at its sole and absolute discretion, and without any notice to the Employer, restrict, suspend or terminate such Employer's access to all or any part of the Dost Platform, deactivate or delete the Employer's account and all related information on the account, delete any content posted by the Employer on Dost and further, take technical and legal steps as it deems necessary.
vi. If Dost charges its Employers a platform fee in respect of any Dost Services, Dost shall, without delay, repay such platform fee in the event of suspension or removal of the Employer's account or Dost Services on account of any negligence or deficiency on the part of Dost, but not if such suspension or removal is affected due to: any breach or inadequate performance by the Employer of any of these Terms of Service; or any circumstances beyond the reasonable control of Dost.
vii. By accepting these Terms of Service Employers are providing their consent to receiving communications such as announcements, administrative messages and advertisements from Dost or any of its partners, licensors or associates.

2. Participation
i. When accessing and interacting with the Dost Platform and Dost Services an Employer will be able to post jobs to source and hire potential candidates and employees for the Employer's organization, view the profiles of suitable candidates who have the requisite skills and experience for the particular job(s) that the Employer is hiring for and schedule interviews with potential candidates/employees.
ii. To post a job a Employer shall be required to provide information about the job such as the job role, whether the job is part-time or full time, the days of work, work timings, the salary range for the job, the number of openings for the said job the minimum education level and the level of experience required for the job. While Dost does not tolerate or allow for discrimination on the basis of gender, Dost also recognizes that certain jobs might be gender specific and Employers have the option of specifying whether a job is gender specific. By agreeing to these Terms of Service and while posting a job on the Dost Platform, Employers undertake that all information posted about a job will at all times be accurate, not be misleading that the Employer is not indulging in any discriminatory practices. The Employer understands and acknowledges that any incorrect information or misrepresentations about a job will affect the efficacy of the Dost Platform and Dost Services and that Dost shall have the right to remove a job posting or suspend the Employer’s account.
iii. The job applications by the candidates on the Dost Platform shall remain active only for a period of 30 (sixty) days from the date of application to the job posts and upon the expiry of the said period of 30 (sixty) days, such job applications shall be archived and status will be changed from “Active” to “Inactive”. The Employers shall not have access to the list to the list of such candidates or to the Inactive Jobs upon the expiry of 30 (sixty) days. The candidates, however, may re-apply to a job post (if still active) after the expiry of 30 (sixty) days from the date such candidate made their first application to the same job post.
iv. Employers agree that they shall at all times be bound by and adhere to the Code of Conduct while posting jobs through the Dost Platform and while using the Dost Services.

3. Intellectual Property
i. The intellectual property rights ("Intellectual Property Rights") in all software underlying the Dost Platform and the Dost Services and material published on the Dost Platform, including (but not limited to) software, advertisements, content (whether written, audio and/or visual), photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clippings, animations etc. is owned by Dost, its affiliates, partners, licensors and/or associates. Employers may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Dost either in whole or in part without express written license from Dost.
ii. Employers are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available via the Dost Platform ("Employers' Content"). Each Employer represents and warrants that they own all Intellectual Property Rights in the Employers’ Content and that no part of the Employer's Content infringes any third-party rights. Employers further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on the Dost Platform, without written authorization from such third party. Employers agree to indemnify and hold harmless Dost, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform, by such Employer or through the Employer's commissions or omissions
iii. Employers hereby grant to Dost and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Employers' Content for any of the following purposes: displaying Employers' Content on Dost distributing Employers' Content, either electronically or via other media, to potential candidates, and/or storing Employers' Content in a remote database accessible by end users, for a charge. This license shall apply to the distribution and the storage of Employers' Content in any form, medium, or technology.
iv. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Dost Platform belonging to any person (including a Employer), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Dost.

4. Third Party Sites, Services and Products
i. Links to other Internet sites or mobile applications owned and operated by third parties may be provided via the Dost Platform. Employers' use of each of those sites is subject to the conditions, if any, posted by those sites. Dost does not exercise control over any Internet sites or mobile applications apart from the Dost Platform and cannot be held responsible for any content residing in any third-party Internet site or mobile application. Dost's inclusion of third-party content or links to third-party Internet sites or mobile applications is not an endorsement by Dost of such third-party Internet site or mobile application.
ii. Employers' correspondence, transactions/offers or related activities with third parties including but not limited to potential candidates, payment providers and verification service providers, are solely between the Employer and that third party. Employers' correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the Employer shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. The Employer agrees that Dost will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor.
iii. The Dost Platform contains content that is created by Dost as well as content provided by third parties (including potential candidates). Dost does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Employers in utilizing the Dost Services provided on the Dost Platform.

5. Participation
i. All information collected from Employers, such as registration (including but not limited to email addresses, mobile phone numbers, government identity documentation) and payment information, is subject to Dost's Privacy Policy.
ii. We do not share personal information of any individual with other companies/entities without obtaining permission. We may share all such information that we have in our possession in accordance with our Privacy Policy
iii. Once the personal information has been shared with you, you shall, at all times, be responsible to secure such information.
iv. You warrant and represent that you shall not disclose or transfer personal information shared by us to any sub-processors without ensuring that adequate and equivalent safeguards to the personal information.
v. You, hereby agree and acknowledge that you will use the information shared with you only for the purpose of the Services. You shall not use such information for any personal or other business purposes. In the event you are found to be misusing the information shared with you, we shall, at our sole discretion, delete your account with immediate effect and you will be blocked from using/ accessing Dost Platform in future.

6. Employer Conduct
i. Employers agree to abide by these Terms of Service and all other rules, regulations and terms of use of the Website. In the event Employer does not abide by these Terms of Service and all other rules, regulations and terms of use, Dost may, at its sole and absolute discretion, take necessary remedial action, including but not limited to: restricting, suspending, or terminating any Employer's access to all or any part of Dost Services; deactivating or deleting a Employer's account and all related information and files on the account. Any amount remaining unused in the Employer's account on the date of deactivation or deletion shall be transferred to the Employer's bank account on record with Dost subject to a processing fee (if any) applicable on such transfers as set out herein.
ii. Employers agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Dost). Employers further agree to update and keep updated their registration information and information related to job posts made on the Dost Platform.
iii. An Employer shall not register or operate more than one Employer account with Dost.
iv. Employers agree to ensure that they can receive all communication from Dost by marking e-mails, sending SMSs or via WhatsApp from Dost. Dost shall not be held liable if any e-mail/SMS remains unread by an Employer as a result of such e-mail getting delivered to the Employer's junk or spam folder.
v. Any password issued by Dost to an Employer may not be revealed to anyone else. Employers may not use anyone else's password. Employers are responsible for maintaining the confidentiality of their accounts and passwords. Employers agree to immediately notify Dost of any unauthorized use of their passwords or accounts or any other breach of security.
vi. Employers agree to exit/log-out of their accounts at the end of each session. Dost shall not be responsible for any loss or damage that may result if the Employer fails to comply with these requirements.
vii. Employers agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software designed to modify or interfere with the Dost Services and/or Dost experience or assist in such activity.
viii. Employers agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying Dost or Dost’s Services.
ix. Employers agree that without Dost's express written consent, they shall not modify or cause to be modified any files or software that are part of Dost's Services or the Dost Platform.
x. Employers agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support Dost or the Dost’s Services (each a "Server"); or (2) the enjoyment of Dost Services by any other Employer or person.
xi. Employers agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt Dost Services or any other person's use or enjoyment of Dost Services.
xii. Employers shall not attempt to gain unauthorised access to Employer accounts, Servers or networks connected to Dost Services by any means other than the Employer interface provided by Dost, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of Dost Services.
xiii. An Employer shall not publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
xiv. Without limiting the foregoing, Employers agree not to use Dost for any of the following:
To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication; To harass, stalk, threaten, or otherwise violate any legal rights of other individuals; To publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content; To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, Dost, any software, hardware, or telecommunications equipment; To advertise, offer or sell any goods or services for any commercial purpose on Dost including but not limited to multi-level marketing for a third party, promoting business of a third party, selling financial products such as loans, insurance, promoting demat account openings, without the express written consent of Dost; To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner; To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material; To restrict or inhibit any other Employer from using and enjoying any public area within our sites; To collect or store personal information about other Employers; To collect or store information about potential candidates; To mine information relating to potential candidates with the aim of creating a database of potential candidates whether or not such database is used or meant to be used by the Employer or any third party associated with the Employer or to whom such Employer makes such mined information available, for either a commercial purpose of for the Employer’s own use at a future date; To interfere with or disrupt the Dost and/or the Dost Platform, Dost servers, or Dost networks; To impersonate any person or entity, including, but not limited to, a representative of Dost, or falsely state or otherwise misrepresent Employer's affiliation with a person or entity; To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Dost or to manipulate Employer's presence on the Dost Platform; To take any action that imposes an unreasonably or disproportionately large load on Dost’s infrastructure; To engage in any illegal activities. To engage in any action that threatens the unity, integrity, defence, security or sovereignty of Pakistan, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation. xv. If an Employer chooses a username that, in Dost's considered opinion is obscene, indecent, abusive or that might subject Dost to public disparagement or scorn, or a name which is an official team/league/franchise names and/or name of any sporting personality, as the case may be, Dost reserves the right, without prior notice to the Employer, to restrict usage of such names, which in Dost’s opinion fall within any of the said categories and/or change such username and intimate the Employer or delete such username and posts from Dost, deny such Employer access to Dost, or any combination of these options.
xvi. Unauthorized access to the Dost Platform is a breach of these Terms of Service, and a violation of the law. Employers agree not to access the Dost Platform by any means other than through the interface that is provided by Dost via the Dost Platform for use in accessing the Dost Platform. Employers agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of the Dost Platform, Dost Services or any information available for access through the Dost Platform or Dost Services, except those automated means that Dost has approved in advance and in writing.
xvii. Use of the Dost Platform is subject to existing laws and legal processes. Nothing contained in these Terms of Service shall limit Dost's right to comply with governmental, court, and law-enforcement requests or requirements relating to Employers' use of Dost.
xviii. Persons below the age of eighteen (18) years are not allowed to register with the Dost Platform. All persons interested in becoming Dost Employers might be required by Dost to disclose their age at the time of getting access to the Dost Platform. If a person declares a false age, Dost shall not be held responsible and such person shall, in addition to forfeiting any and all rights over their Dost account, shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration being made. In case the person making the false declaration is below the age of 18 such person’s legal guardians shall indemnify and hold Dost, its Directors, officers, employees, agents, affiliates harmless of any and all losses that may be suffered by Dost its Directors, officers, employees, agents, affiliates by virtue of such false declaration having been made by said person.
xix. Dost may not be held responsible for any content contributed by Employers on the Dost Platform.

7. Eligibility
i. The Dost Platform is open only to persons above the age of 18 years.
ii. The Dost Platform is open only to persons, currently residing in Pakistan.
iii. Persons who wish to participate must have a valid email address and/or mobile phone number.
iv. Dost may on receipt of information bar a person from accessing their Dost account if such person is found to be in violation of any part of these Terms of Service.
v. Only those Employers who have successfully registered on the Dost Platform shall be eligible to Post Jobs.

8. Dispute and Dispute Resolution
i. If any dispute arising out of, or in connection with, the Dost Services provided by Dost via the Dost Platform, the construction, validity, interpretation and enforceability of these Terms of Service, or the rights and obligations of the Employer(s) or Dost, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below arises between the Employer(s) and Dost ("Dispute"), the disputing parties hereto shall endeavor to settle such Dispute amicably. The attempt to bring about an amicable settlement shall be considered to have failed if not resolved within 30 (thirty) days from the date of communicating the Dispute in writing.
ii. If the parties are unable to amicably settle the Dispute as mentioned above, any party to the Dispute shall be entitled to serve a notice invoking Arbitration. The Dispute shall be referred to and finally resolved by arbitration. The Arbitration shall be conducted by an Arbitral Tribunal consisting of a sole arbitrator in accordance with the Law of Islamic Republic of Pakistan, which rules are deemed to be incorporated by reference in this clause. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The law governing the arbitration agreement shall be Islamic Republic of Pakistan’s Law.
iii. Nothing shall preclude any Party from seeking interim or permanent equitable or injunctive relief, or both, from the competent courts, having jurisdiction to grant relief on any Disputes. The pursuit of equitable or injunctive relief shall not be a waiver of the duty of the Parties to pursue any remedy (including for monetary damages) through the arbitration described herein.
iv. The arbitration award will be final and binding on the Parties.

9. Release and Limitations of Liability
i. Employers shall access the Dost Services provided via the Dost Platform voluntarily and at their own risk. Dost shall, under no circumstances be held responsible or liable on account of any loss or damage sustained by Employers or any other person or entity during the course of access to the Dost Platform.
ii. By accessing the Dost Platform and Dost Services provided therein, Employers hereby release from and agree to indemnify Dost, and/or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access of the Dost Platform and the Dost Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
iii. Dost accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the data/information collated and published on the Dost Platform.
iv. Employers shall be solely responsible for any consequences which may arise due to their access of Dost Services by conducting an illegal act or due to non-conformity with these Terms of Service and other rules and regulations in relation to Dost Services, including provision of incorrect personal details. Employers also undertake to indemnify Dost and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Dost on account of such act on the part of the Employers.
v. Employers shall indemnify, defend, and hold Dost harmless from any third party/entity/organization claims arising from or related to such Employer's engagement with the Dost Platform. In no event shall Dost be liable to any Employer for acts or omissions arising out of or related to Employer's engagement with the Dost Platform.
vi. In consideration of Dost allowing Employers to access the Dost Platform, to the maximum extent permitted by law, the Employers waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Dost, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of Dost Services

10. Disclaimers
i. To the extent permitted under law, neither Dost nor its subsidiary company, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.
ii. To the extent permitted under law, Dost shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, products, Dost Services or sites.
iii. Any material accessed, downloaded or otherwise obtained through the Dost Platform is done at the Employer's discretion, competence, acceptance and risk, and the Employer will be solely responsible for any potential damage to Employer's computer system or loss of data that results from an Employer's download of any such material.
iv. Dost shall make best endeavours to ensure that the Dost(s) is error-free and secure, however, neither Dost nor any of its partners, licensors or associates makes any warranty that: the Dost Platform will meet Employers' requirements, Dost Platform will be uninterrupted, timely, secure, or error free the results that may be obtained from the use of Dost Platform will be accurate or reliable; and the quality of any products, Dost Services, information, or other material that Employers purchase or obtain through the Dost Platform will meet Employers' expectations. v. In case Dost discovers any error, Dost reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit, including through a set-off of the erroneous payment from amounts due to the Employer or deduction from the Employer's account of the amount of erroneous payment. In case of exercise of remedies in accordance with this clause, Dost agrees to notify the Employer of the error and of the exercise of the remedy(ies) to rectify the same.
vi. To the extent permitted under law, neither Dost nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if we have been advised of the possibility of such damages.
vii. Any Dost Services being hosted or provided, or intended to be hosted on the Dost platform and requiring specific permission or authority from any statutory authority or any state or the government authorities, or the board of directors shall be deemed cancelled or terminated, if such permission or authority is either not obtained or denied either before or after the availability of the relevant Dost Services are hosted or provided.
viii. To the extent permitted under law, in the event of suspension or closure of any Dost Services Employers shall not be entitled to make any demands, claims, on any nature whatsoever.
